A court in Astana has placed journalist Botagoz Omarova under house arrest for two months in a case concerning the alleged dissemination of knowingly false information. The decision has sparked significant concern among media professionals and human rights advocates, who view it as an act of pressure on freedom of speech.

The events unfolded on March 20, 2026, when Omarova was invited for questioning at the Astana Police Department. According to colleagues, she attended voluntarily. Over several hours, her legal status shifted from that of a witness with the right to legal counsel to a suspect under Article 274 of the Criminal Code. She spent over eight hours at the police station before a night court session around 1:30 AM imposed the restrictive measure. A search was subsequently conducted at her apartment between 3 AM and 5 AM on March 21.

The police confirmed that a pre-trial investigation had been initiated based on a statement received against "citizen O.B." for signs of spreading false information. They stated that investigative actions were carried out with her participation but did not disclose details of the case or specify which publication prompted it.

"For initiating a case under Article 274 of the Criminal Code, three conditions must be met: the information must be false, the person must have known this beforehand, and substantial harm must have been caused," emphasized representatives from the "Adil Soz" International Foundation for Freedom of Speech.

The "Adil Soz" foundation suggested that reports on Omarova's Telegram channel about workers' complaints regarding unpaid wages might have triggered the case. The organization pointed to Article 68 of Kazakhstan's Law "On Mass Media," which states that journalists are not liable for verbatim reproduction of statements by individuals or legal entities unless such information is prohibited by law.

In response to these developments, a group of Kazakh journalists and citizens issued an appeal to President Kassym-Jomart Tokayev. They described Omarova as a journalist with over two decades of experience and an impeccable reputation. The appeal argues that Article 274 is often used as an instrument of pressure against journalists and calls on the president to take personal control of the case and consider decriminalizing this article.

Minister of Culture and Information Aida Balaeva commented on the situation, stating her ministry is monitoring it closely. She stressed that premature conclusions should be avoided until all procedures are complete and emphasized that all procedural actions must strictly comply with the law. While reminding journalists of their legal duty to verify information, she also acknowledged the protections offered by Article 68.

The case against Botagoz Omarova occurs amid an ongoing debate in Kazakhstan about applying criminal charges related to "false information" against journalists covering socially significant topics.
