Kazakh Woman Freed After Court Reconsiders Homicide Case Involving Husband's Defense

A court in the Abai region has reviewed the case of a woman convicted for fatally striking a man who was attacking her husband. The Cassation Court for Criminal Cases reported that the incident occurred in July 2024.

According to the case materials, the woman intervened to save her spouse during a physical altercation. The assailant had pinned down her husband, pressing his neck with his foot and strangling him. In response, she struck the attacker on the head with a piece of wood, which resulted in his death.

The court of first instance found the Kazakh woman guilty of intentional infliction of grievous bodily harm that negligently caused the victim's death. She was sentenced to six years of imprisonment and ordered to pay 3 million tenge in moral compensation. An appellate court upheld this verdict.

During cassation proceedings, the defense argued that her actions were taken in defense of her husband and should be classified under a less severe article. The Cassation Court agreed she was acting to protect her spouse but concluded that the limits of necessary self-defense were exceeded, as a heavy object was used to strike a vital area—the head.

Nevertheless, the court took into account several mitigating circumstances: the woman's remorse, having a minor child, her status as a third-group disabled person, and the fact that the deceased had provoked the conflict.

As a result, the charges were reclassified to a less severe article, and she was sentenced to one year of imprisonment. Since she had already served this term in pre-trial detention, she was released immediately in the courtroom.
